General Conditions of BlueBiz Metropolitan France
Active as of November 7, 2011


1. Définitions

Unless otherwise explicitly stated below, the capitalized terms appearing in these General Conditions will have the following definitions:
Air France: Société Air France, a limited liability company with a capital of 126,748,775 euros under French law. Its head office is located at 45, rue de Paris, 95747 Roissy CDG Cedex, France. It is registered with the Registre du Commerce et des Sociétés of Bobigny under the number 420 495 178.
KLM: Koniklijke Luchtvaart Maatschappij NV (KLM Royal Dutch Airlines), limited liability company under Dutch law. Its head office is located at Amsterdamseweg 55, Amstelveen, Netherlands. It is registered with the Amsterdam Chamber of Commerce and Industry under the number 33014286.
Administrator: a Member Company staff member who has been designated by the company to manage its BlueBiz account on behalf of the Member Company and to represent said company in the framework of the BlueBiz Program.
Air France - American Express Corporate Card Option: option to take the Air France - American Express Corporate Card, for which the Member Company can sign up with American Express and which provides it with an annual bonus of Blue Credits applied directly to the Member Company´s BlueBiz account.
Air France, KLM, Delta, and Alitalia Flights: flights with Air France and/or KLM and/or Delta and/or Alitalia flight numbers provided by Air France, KLM, Delta, Alitalia, or their partner airlines listed on the airfrance.com, klm.com, delta.com, and alitalia.com websites.
Blue Credits: points obtained by the Member Company when purchasing tickets from Air France (beginning with 057), KLM (beginning with 074), Delta (beginning with 006), and Alitalia (beginning with 055). The points can be used to obtain BlueBiz Award Tickets, Metropolitan France Travel Cards, and Other BlueBiz Benefits, as expressed in these General Conditions.
BlueBiz Award Ticket: ticket issued for Air France and/or KLM and/or Alitalia and/or Delta airlines, which can be obtained with Blue Credits.
BlueBiz Customer Reference: BlueBiz account number created by AIR FRANCE KLM and communicated to the Member Company when it accepts the General Conditions of BlueBiz; this reference must be used for all tickets issued on the Member Company account.
BlueBiz Customer Service: service that the Member Company can contact in order to ask questions concerning the Program.
BlueBiz Program or BlueBiz: the AIR FRANCE KLM program reserved for companies whose employees travel on Air France, KLM, Delta, and Alitalia airlines; Member Companies can earn Blue Credits and exchange them for BlueBiz Award Tickets on Air France, KLM, Delta, and Alitalia flights.
BlueBiz Program Booking Tool: online booking tool located on the airfrance.com website for booking BlueBiz Award Tickets and Metropolitan France Travel Cards.
BlueBiz Publications: general term for communications methods used regularly by BlueBiz to provide updates concerning the BlueBiz program, such as BlueBiz sections on the websites of Participating Airlines as well as BlueBiz e-mails.
BlueBiz Statement: statement listing all operations performed by the Member Company in the framework of the BlueBiz program and showing a Blue Credits total.
Commercial agreement: Contract concluded between Air France, KLM, Delta, Alitalia, and another company in order to set fare conditions applicable to the employees of this company traveling on Air France and/or KLM and/or Delta and/or Alitalia airlines.
Country of Membership: country in which the Member Company is located and in which it joined the BlueBiz program (metropolitan France).
Date of entry into force: date on which the Member Company enters the BlueBiz Program and the terms of the agreement enter into force and are communicated to the Member Company by Air France and KLM by a confirmation e-mail.
General Conditions of BlueBiz: the present General Conditions govern relations between Air France, KLM and the Member Company.
Member Company: a legal entity that has chosen to participate in the BlueBiz program, fulfilled the required conditions, and accepted the General Conditions of BlueBiz.
The French-Europe-North Africa discount Pass: card that offers reductions for Air France flights to France, Europe, and North of Africa, which can be obtained with Blue Credits.
Other BlueBiz Benefits: advantages other than BlueBiz Award Tickets and Metropolitan France Travel Cards that are obtained with Blue Credits.
Participating Companies: companies participating in the BlueBiz program and using it as a program exclusively intended for businesses; Alitalia and Delta are Participating Companies; the list of Participating Companies is subject to change at any time.
Partner Companies: airlines designated by Air France and KLM as partner companies; it is possible to earn Blue Credits and/or claim tickets on flights operated by these companies.
Travel Agencies: IATA or non-IATA travel agencies or tour operators that issue tickets.

2. General Information

2.1. Upon becoming a member of the BlueBiz Program, the Member Company states its acceptance of the General Conditions of BlueBiz and agrees to respect them. Air France and KLM reserve the right to delete or alter the General Conditions, particularly as they relate to the Blue Credits earning scale, and also to terminate the BlueBiz program in its entirety. Notification of changes made to the BlueBiz program, including changes to the General Conditions, will be made through BlueBiz Publications and will be effective upon notification by Air France and KLM. It will be assumed that the Member Company accepts the changes if it does not send a written claim to Air France and KLM within 30 days and/or if it uses its BlueBiz account, earns Blue Credits, requests a BlueBiz ticket or an Other BlueBiz Benefit in the framework of the program during this period. If a Member Company does not accept a change, it can terminate its contract as outlined in 2.2. Air France and KLM agree to take all necessary measures to inform the Member Company of changes made to the BlueBiz Program or its termination, but Air France and KLM will not be responsible for any loss or damage resulting from changes or termination.
2.2 If a Member Company wishes to terminate its contract, it must inform Air France and KLM immediately and will no longer earn Blue Credits. Blue Credits earned previously can be used within 8 months of contract termination.
2.3. If Air France and KLM terminate the BlueBiz Program, the Member Company will no longer earn Blue Credits upon notification of termination. In this case, Blue Credits earned previously can be used within 6 months of the termination of the BlueBiz Program.
2.4 In case of false declaration, fraud, violation of the General Conditions, or improper use of the BlueBiz Program, including failure to follow the policies and procedures of the BlueBiz Program or instructions from Air France and KLM employees, improper management on the part of the Member Company by its Administrator and/or employees, and notably in case of difficulty, harassment of Air France, KLM, Delta, Alitalia, Partner Companies, and/or companies affiliated with Air France and/or KLM, Air France and KLM may immediately and by full right terminate the contract concluded with the Member Company with immediate effect and/or nullification of the BlueBiz Statement, thus nullifying all Blue Credits earned or BlueBiz Award Tickets. If the Member Company transfers its head office outside of the country of membership, or if the Member Company ceases its activity for liquidation (involuntary) or any other reason, Air France and KLM may terminate the terms of the contract with immediate effect and/or nullify the BlueBiz Statement and all Blue Credits earned.
2.5. If a Member Company does not earn Blue Credits over a period of 36 months, Air France and KLM reserve the right to terminate the contract with the Member Company.
2.6. Air France and KLM will use BlueBiz Publications to inform the Member Company of all options for converting Blue Credits into BlueBiz Tickets or Other BlueBiz Benefits, which are subject to availability and a capability check at the time of booking. Air France and KLM reserve the right to impose additional conditions at any time for obtaining BlueBiz Award Tickets and Other BlueBiz Benefits, notably the right to make changes and/or increase the number of Blue Credits needed. Air France and KLM will actively verify that the BlueBiz Award Tickets and Other BlueBiz Benefits presented to the Member Company as available are, in fact, available. However, Air France and KLM can neither guarantee nor ensure that the above-mentioned advantages will be available.
2.7. The KLM conditions of carriage, as registered with the Court of The Hague, are applicable to all KLM flights and can be found on www.klm.com.
The Air France conditions of carriage are applicable to all Air France flights and can be found on www.airfrance.com.
The Alitalia conditions of carriage are applicable to all Alitalia flights and can be found on www.alitalia.com.
The Delta conditions of carriage are applicable to all Delta flights and can be found on www.delta.com.
 
For flights operated by Partner Companies and/or the Other Advantages offered by partners of Air France, KLM, Delta, and Alitalia, the conditions of carriage for these companies will apply.
 

3. Membership conditions

3.1. Only companies that have not concluded (and/or are not currently negotiating or concluding) a Commercial Agreement with Air France, KLM, Delta, and Alitalia and whose head offices are located in the Country of Membership can sign up for the BlueBiz Program. The Member Company will have to designate an Administrator during the membership process. This administrator must be employed at the company signing the BlueBiz contract.
The Administrator will complete the membership form available on airfrance.com, klm.com, alitalia.com, or at Travel Agencies. Additionally, the Administrator must accept the General Conditions at this time. Any employee submitting a membership request form for his or her company confirms that the company has authorized said action.
The e-mail address of the Administrator must be provided during the membership process. All communications concerning the Program will be sent to this e-mail address. The Member Company must inform Air France and KLM as soon as possible of any change to the Contract (e-mail address, etc.) in the framework of the BlueBiz Program.
 
3.2. Travel agents (and affiliates) or travel organizations are not authorized to join the BlueBiz Program.
3.3. Once the membership procedures have been performed, Air France and KLM will verify that the conditions to join the BlueBiz Program have been met and will inform the Administrator as soon as possible by e-mail of the company´s acceptance or refusal. The Member Company is responsible for the use of its BlueBiz Customer Reference and password. Only one BlueBiz Customer Reference will be provided to the company.
3.4. The BlueBiz contract cannot be transferred, and the Administrator must immediately inform Air France and KLM of any change in address, transfer of its head office outside the Country of Membership, termination of its activities due to liquidation (involuntary), or change of Administrator.

4. Conditions for earning Blue Credits

4.1. The Member Company can earn Blue Credits on Air France, KLM, Delta and Alitalia flights, as long as the following conditions are met: Blue Credits will be awarded to the Member Company only for flights with tickets issued by Air France (beginning with 057), KLM (beginning with 074), Delta (beginning with 006), or Alitalia (beginning with 055), purchased and issued only in the Country of Membership by employees of member company, and actually taken by an eligible passenger, according to the Blue Credits earning scale in force on the date of the flight in question; the booking class and fare indicated on the ticket are not excluded from the program, the KLM ticket, Air France ticket, or Alitalia ticket is in the name of an employee of the Member Company; the BlueBiz Customer Reference must be communicated upon booking and must be registered in the booking files.
Otherwise, issued tickets cannot be taken into account for earning Blue Credits. Blue Credits will be awarded only after the flight has taken place. BlueBiz Award Tickets do not earn Blue Credits.
4.2. In addition to the Blue Credits awarded to the Member Company, Flying Blue Miles or those of a Participating Company’s loyalty program will be awarded to the employee of the Member Company, as outlined in the General Conditions of these loyalty programs. Award tickets from Flying Blue or another Participating Company do not earn Blue Credits.
4.3. Blue Credits are valid for 2 full calendar years from the date on which they are credited to the BlueBiz statement, subject to the conditions defined in article 2 above.
4.4. Blue Credits cannot be divided and have no commercial exchange value; they cannot be reimbursed for their monetary value, and they cannot be transferred to another BlueBiz account of the Member Company. In case of merger or purchase of the Member Company, Blue Credits can only be transferred to another BlueBiz account with express written agreement from the BlueBiz Customer Service. Blue Credits will be credited to the corresponding BlueBiz account 6 to 8 weeks following the trip, subject to delays for additional treatment by Air France and KLM.
4.5. If the BlueBiz Customer Reference is not communicated during booking, the Administrator can ask for these unclaimed Blue Credits to be credited to their account using the unclaimed credits request form available on airfrance.com.
4.6. Tax requirements and/or financial requirements related to BlueBiz and/or resulting from the use of BlueBiz Tickets and/or Other BlueBiz Benefits are the responsibility of the Member Company.
4.7. Certain special fares do not earn Blue Credits and are excluded from the BlueBiz program by Air France and KLM and Participating Airlines. BlueBiz earning scales are provided on airfrance.com.
4.8. The BlueBiz Member Company having signed up for the Air France - American Express Corporate Card Option can earn an annual bonus of Blue Credits as outlined in the general conditions of this Corporate Card Option. This annual bonus is calculated according to a bonus scale based on revenue without taxes earned on flights with an Air France flight number and/or a KLM flight number and/or a HOP! flight number, purchased and issued in the Country of Membership with an Air France ticket number (057), and paid for with an Air France - American Express Corporate Card solution owned by the Member Company. The scale defining the level of revenue and the amount of corresponding Blue Credit bonuses is available on airfrance.com and lacartecorporate.com.

5. Conditions for using Blue Credits

5.1. Except for other explicitly indicated cases, Blue Credits can only be exchanged by the Administrator for employees of member company; they cannot be exchanged for money, Flying Blue Miles, or other advantages obtained through loyalty programs.
5.2 Blue Credits can be exchanged:
a) for BlueBiz Award Tickets on Air France, KLM, Delta, Alitalia and Partner Airline flights available using the BlueBiz Program Booking Tool on the website of the Country of Membership (available to the Member Company in its personalized space).
b) for France-Europe-North of Africa Travel Pass
These Travel Cards can be requested by the Administrator using the specific form available on airfrance.com.
5.3. BlueBiz Award Tickets can be obtained using the BlueBiz Program Booking Tool, subject to flight availability and a sufficient amount of Blue Credits. The details of the electronic tickets (e-tickets) will be sent to the e-mail address listed in the BlueBiz Award Tickets booking file. An e-mail will also be sent to the Administrator to confirm the debit of the amount of Blue Credits corresponding to the amount needed for BlueBiz Award Tickets from the BlueBiz account of the Member Company.
Air France is not responsible for the loss or destruction of a BlueBiz Award Ticket or Other BlueBiz Benefit.
 
5.4. Blue Credits can be exchanged for BlueBiz Award Tickets at the public fare rate using the BlueBiz program Booking Tool, except for reduced-fare tickets, such as free tickets, award tickets, and all other tickets for which the ordinary public fare rate does not apply. Participating Companies reserve the right to exclude certain booking classes.
5.5. An administrator BlueBiz can change and/or cancel BlueBiz Award Tickets using BlueBiz Customer Service, if the fare rules corresponding to a specific fare base allow it :

All change request for BlueBiz Award Tickets and Other BlueBiz Benefits must be submitted to BlueBiz Customer Service prior to the flight´s departure, according to fare's rule and BlueBiz Customer Service's opening hours (service is closed during weekends and holidays). Depending on the fare rules in force, changing a BlueBiz Ticket may lead to an adjustement of Blue Credits.
For all refund request for BlueBiz Award ticket and other BlueBiz benefits, refund of BlueCredit will be possible according to the fare's conditions in force.
If reservation was canceled before the departure of flight , and to beneficit all or a part of the refund according to fare's conditions, BlueBiz Award ticket will be cancelled within the time limit.
 
5.6. Metropolitan France Travel Cards can be refunded for Blue Credits according to the refund conditions in force, which are available on airfrance.com. All refund requests for Metropolitan France Travel Cards must be made with BlueBiz Customer Service whose contact information is provided in article 6 below.

6. Privacy

6.1. Personal information relating to the participation of the Member Company and the Administrator ("Personal Information”) in the BlueBiz Program will be treated and used by Air France and KLM in compliance with regulations on Information Protection set up by the European Directive 95/46, such as the Dutch law on Information Protection (“Wet Bescherming Persoonsgegevens") and the French law on Computing and Privacy (Informatique et Libertés of January 7, 1978, modified by the law of August 6, 2004). KLM has informed the Dutch authority on information protection ("College Bescherming Persoonsgegevens") of the treatment of this Personal Information. Air France has informed the French information protection authority ("Commission Nationale Informatique et Libertés" - CNIL) of the treatment of this Personal Information.
6.2. Personal Information will be used and exchanged between Air France, KLM, Delta, Alitalia and their partners for the purpose of the proper operation of the BlueBiz program. Furthermore, Personal Information will be used for direct marketing and communications by Air France, KLM, Delta, Alitalia and their partners. If the Administrator does not want to receive information on products and services, they can inform BlueBiz Customer Service at any time. They also have the right to access and change all information concerning them.

7. Membership verification

7.1. Air France and KLM reserve the right to verify the validity of the Member Company´s participation in the BlueBiz Program at any time, without informing the Administrator beforehand. These verifications aim to help Air France and KLM guarantee compliance with the Conditions of the Program and detect fraud.
7.2. If irregularities and/or violations are observed during verification, Air France and KLM are authorized to suspend earning and use of Blue Credits, in a unilateral way, until the irregularities and/or violations have been treated satisfactorily for Air France and KLM. Air France and KLM are authorized to terminate the contract as indicated in article 2.4.

8. Responsibility and applicable law

8.1. Air France, KLM and Partner Companies cannot be held responsible for unauthorized membership and/or improper use of the BlueBiz Program and/or fraudulent acts committed by Administrators. In case of irregularity, the Administrator in question must immediately ask BlueBiz Customer Service to block the account of their Member Company. The Member Company will be held responsible for all (alleged) improper use of the BlueBiz account, such as the unauthorized use of Blue Credits. Air France and KLM will take no responsibility of any kind for damage, delays, loss, injuries, or deaths related to or resulting from the services or benefits provided or not by AIR FRANCE KLM, Delta, Alitalia and Partner Companies, unless these damages or losses are caused by negligence on the part of Air France or KLM or an intentional act while knowing that these damages could occur, except for other measures stipulated by the Warsaw Convention (amended version) or the Montreal Convention, depending on the case. Air France and KLM cannot be held responsible for any loss or damage resulting from the termination of the BlueBiz program or any changes made to it.
8.2. The BlueBiz Program is governed by French law and any resulting litigation will fall into the exclusive jurisdiction of the Tribunal de Commerce of Paris, except for other measures outlined by applicable law notwithstanding the law and jurisdiction applicable to the contract. Local legislation may impede Air France and KLM from offering all or part of the BlueBiz Program in certain countries or to certain companies; Air France and KLM cannot be held responsible when acting in compliance with legislation and reserve the right to terminate contracts with Member Companies and/or nullify Blue Credits.
8.3. These General Conditions are prepared in the French language. Though translated into English here, only the French version is legally binding.

9. Claims

9.1. Despite the precautions taken by Air France and KLM in the framework of the BlueBiz Program, all claims made by a Member Company concerning all or part of the BlueBiz Program must be submitted to BlueBiz Customer Service. For claims concerning BlueBiz Award Tickets and Other BlueBiz Benefits, the Administrator must inform BlueBiz Customer Service within 6 months of using the BlueBiz Award Ticket and/or Other BlueBiz Benefit.
9.2. Information concerning BlueBiz contacts is available on the local websites of Air France, KLM and Participating Airlines (www.airfrance.com, www.klm.com, www.delta.com, www.alitalia.com).
